Terms and Conditions for Tailor Made European Itineraries


Anthony Bay Is Europe is a registered French Company, referred to as “AB EUROPE” within these Terms and Conditions.

What is Included
Except as stated otherwise in your itinerary, prices include accommodations and all associated taxes thereto; specified meals and light beverages; sightseeing services and entrance fees; entertainment and activities; local guides; transfers and other planned activities as specified in your final itinerary; gratuities when specified. AB EUROPE may modify any service; additional services available upon request.

What is Not Included
Passenger insurance; all costs associated with obtaining passports or entry visas; international airfares; internal airfares in an itinerary; excess baggage charges on internal flights; gratuities to your guide; gratuities when not specified; meals other than those specified in the itinerary; beverages other than those specified in the itinerary; sightseeing not included in the itinerary; personal expenses such as phone calls, mini bar, room service, alcoholic and bar beverages; laundry; optional incidental expenses. No flights detailed in an itinerary (including all international and transatlantic flights) are included in the tour cost, unless specified otherwise (each airline’s baggage restrictions apply).

When requested, AB EUROPE will provide a personal Guide for your itinerary.  Circumstances may require re-designation of a specific Guide.

Itinerary & Price Changes
AB EUROPE makes every effort to operate all itineraries as advertised.  From time to time, it may, however, alter or curtail any itinerary if it deems best.  AB EUROPE may also pass on to its clients any increased costs caused by delays, unexpected external factors, changes in fees and taxes, or other events. No refunds will be made for unused services once travel has commenced.

Passports and Visas
All passengers must hold a valid passport for international destinations. Securing visas and required documentation is the responsibility of the passenger. Please check with your Travel Agent for latest visa requirements. Passports must be valid for six (6) months after the return of your journey and should also have at least three blank pages remaining for visas and immigration stamps. AB EUROPE is not responsible for its clients being denied entry to a country.

A copy of your valid passport must be submitted to AB EUROPE for an itinerary which includes an internal flight.

Air Services
AB EUROPE is not liable or responsible for any accident, death, personal injury, illness, property damage, delay or other losses or expense of any nature whatsoever arising directly or indirectly out of any act of God, or any actions or missions or default of, any carrier.  All carriers are independent contractors and are not owned, managed, controlled or operated by AB EUROPE. Any airline ticket issued to the passenger by AB EUROPE constitutes a contract between the passenger and the airline (and not with AB EUROPE), even if purchased through AB EUROPE. AB EUROPE is not liable for, and does not assume responsibility or accept claims with regard to, seat assignments, name changes, schedule changes, flight changes, cancellations, claims for a refund, or reimbursement of airline ticket fees, or any other loss or expense incurred by the passenger for any reason whatsoever (including, without limitation to bankruptcy, insolvency, reorganisation of a carrier or similar relief from creditors) when purchasing or using the carrier’s services.

International airfares are not included in itinerary pricing.

Although AB EUROPE has no restriction on the number of bags per person, airlines’ baggage restrictions and limitations on liability apply. Consult AB EUROPE for further details.

Photography and Video on Tour
AB EUROPE reserves the right to take photographs or video films during the operation of any part of an itinerary and to use those photographs and videos for promotional purposes. By booking a program with AB EUROPE, you agree to allow your likeness and any images of you to be used for promotional purposes. If you object, please inform AB EUROPE.

Fitness and health
A minimum level of fitness is required. AB EUROPE may, in its sole discretion, decline anyone whom it considers unsuitable due to fitness level or whose condition is such that it could create a hazard or otherwise impact the trip. AB EUROPE cannot guarantee providing individual assistance to a passenger for walking, wheelchairs, motorized scooters, dining or other similar personal needs. Passengers needing such assistance must be accompanied by an able companion who will assist them.

AB EUROPE’s Right to Decline
AB EUROPE may, in its sole discretion, decline the booking of any passenger or remove any passenger at his or her expense who cannot, or refuses, to comply with AB EUROPE’s Terms and Conditions. AB EUROPE reserves the right to refuse or to remove (at his or her sole expense), anyone whose behaviour disrupts the trip or whose health or behaviour may create a hazard.

Limitations on Our Role and Our Responsibility
AB EUROPE does not own or operate any entity which provides goods or services for your trip. AB EUROPE purchases services from various independent suppliers; e.g., transportation (by aircraft, coach, train, and otherwise), hotel and other lodging accommodations, restaurant, ground handling, and other services. While AB EUROPE uses its experience, expertise, and relationships to identify and use the best suppliers for each tour or program, these suppliers are nevertheless independent contractors, and only they are responsible for their performance, and only they are liable for shortcomings in their performance. AB EUROPE, its employees, shareholders, officers, directors, successors, agents and assigns are not liable for any negligent or willful act of any supplier or any other third person.

In addition and without limitation, AB EUROPE is not responsible for any injury, financial loss, death, inconvenience, prevention, delay, physical loss, or damage to personal property in connection with the provision of any goods or services, whether resulting from, among other things, acts of God or force majeure, illness, disease, acts of war, civil unrest, insurrection or revolt, animals, strikes, lockouts, or other labour disputes, refusal of authorities to issue permits, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of aircraft or other means of transportation, or for failure of any transportation mechanism to arrive or depart on time. Passengers assume all responsibility associated with participating in their trip.

Dispute resolution
If a dispute arises out of or relates to this contract, or the breach thereof, and if the dispute cannot be settled through negotiation, the parties agree first to try in good faith to settle the dispute by mediation in accordance with the International Mediation Rules of the International Centre for Dispute Resolution administered by the American Arbitration Association or, at AB EUROPE’s sole election, other American Arbitration Association rules before resorting to arbitration, litigation or some other dispute resolution procedure.

Any unresolved controversy or claim arising out of or relating to this contract, or the breach thereof, shall be determined by arbitration administered by the American Arbitration Association in accordance with its International Arbitration Rules or, at AB EUROPE’s sole election, any other American Arbitration Association rules. The language of the arbitration shall be English.

Travel Advisories and Warnings
It is the responsibility of the passenger to become informed about the most-current travel advisories and warnings by referring to the U.S. State Department’s travel website (http://travel.state.gov) or by phone at (888) 407-4747. In the event of an active State Department Travel Warning against travel to the specific location(s) of the trip, should the passenger still choose to travel, notwithstanding any travel advisory or warning, the passenger assumes all risk of personal injury, death or property damage that may arise.

For all itineraries a non-refundable Itinerary Preparation fee of 300 euros is required, after initial consultation, so as to continue to continue receiving AB EUROPE’s advice on your itinerary.

For all itineraries and programmes, 50% payment is payable upon booking, with the balance due 30 days prior to the date of the commencement of your itinerary with AB EUROPE. Failure to pay the balance will mean space is automatically released and your deposit will not be returned. If your reservation is made within 30 days of departure, the entire cost of the trip must be paid at the time of the request.

Cancellation and Penalties

Regardless of reason, cancellations received by AB EUROPE up to 30 days before departure date of the itinerary will be subject to a cancellation fee of 500 euros per person booked for itineraries of 1 – 2 days, 750 euros per person booked for itineraries of 3 – 6 days, 1,000 euros per person booked for itineraries of more than 7 days. AB EUROPE will also deduct, in addition to the 500 euros, 750 euros or 1,000 euros fee per person booked, any monies they were unable to claim from suppliers due to non-refundable payments having been made to them by AB EUROPE. Cancellation 30 – 7 days before departure will be subject to 75% of the full cost of the itinerary per person booked; cancellation less than 7 days prior to arrival date will be subject to 100% of the full cost of the itinerary per person booked.

Acceptance of Terms and Conditions
Payment of the deposit and/or full payment to Anthony Bay’s Europe® constitutes acceptance of the Terms and Conditions as set out herein and in any more specific pre-departure passenger documentation (in the case of credit card, it is acceptance if the credit card is used with or without an actual signature).
